Terms of Service

1. Acceptance & Eligibility

By accessing or using TheGame.vc ("the Service"), you agree to these Terms. If you do not agree, do not use the Service. The Service is not directed to children under 13; by using it, you represent you are at least 13 and that your use complies with applicable law.

2. It's A Fictional Game, Not Financial Advice

TheGame.vc is a fictional simulation game offered for entertainment only. The game, including but not limited to all startups, founders, funds, companies, brands, products, metrics, scores, scenarios, narratives, events, outcomes, dialogue, and any other content generated, displayed, or referenced by the Service, is entirely fictional and exists only within the Service. Any resemblance between such content and any real person (living or deceased), real company, real fund, real brand, real product, real organization, or real event is unintentional and purely coincidental.

No advice; no advisory relationship. Nothing in or generated by the Service is, or should be construed or relied upon as, financial, investment, securities, venture-capital, private-equity, banking, brokerage, legal, tax, accounting, regulatory, or other professional advice, an opinion on the merits of any investment, or a recommendation, endorsement, solicitation, or offer to buy, sell, hold, subscribe for, allocate to, or invest in any security, fund interest, token, digital asset, commodity, derivative, instrument, company, or other asset of any kind. The operator is not a registered broker-dealer, investment adviser, investment company, fund manager, exempt reporting adviser, financial institution, or fiduciary in any jurisdiction, and is not acting in any such capacity through the Service. Your use of the Service does not create any advisory, fiduciary, agency, partnership, joint-venture, employment, or similar relationship between you and the operator.

No real investments, no real returns. No real money, capital, securities, fund interests, tokens, or other assets are accepted, held, managed, custodied, transferred, allocated, or invested through the Service, and no real returns, distributions, carried interest, fees, or other economic benefits of any kind are generated, owed, or payable to or by any user. In-game currencies, scores, valuations, multiples, IRRs, MOICs, exits, dividends, distributions, cap tables, term sheets, and any similar figures or artifacts are fictional gameplay mechanics with no monetary value and no relationship to any real instrument or transaction. The Service is not a source of research, data, or predictions; in-game figures and outcomes are illustrative only, are not warranted for accuracy or suitability, and must not be relied upon for any real decision. Consult a qualified, licensed professional in your jurisdiction before making any real financial, investment, legal, or tax decision.

Assumption of risk; jurisdictional responsibility. You access and use the Service voluntarily, for entertainment only, and at your sole risk. You are solely responsible for ensuring that your access to and use of the Service is lawful in your jurisdiction, and you agree not to use the Service where doing so would be unlawful or would cause the operator to become subject to regulation in any jurisdiction in which it is not already registered or licensed. To the maximum extent permitted by law, the operator disclaims all liability for any decision made, action taken, or action not taken by you or any third party in reliance on anything appearing in or generated by the Service.

3. Acceptable Use

You agree not to:

• disrupt, overload, probe, scrape, or damage the Service or its infrastructure
• submit fraudulent, automated, abusive, or manipulated leaderboard entries
• submit any fund name or other text that is offensive, unlawful, misleading, defamatory, harassing, hateful, sexually explicit, or that impersonates any person or entity
• Fund-name submissions. When you submit a fund name to the leaderboard you represent and warrant that: (a) you have the right to submit and license it under these Terms; (b) you are not intentionally impersonating, passing yourself off as, or trading on the goodwill of any real venture firm, fund, company, brand, product, organization, or public figure; and (c) to your knowledge the name does not infringe any third party's trademark, copyright, right of publicity, or other proprietary right. We may, at our discretion, refuse or remove any submission that appears to infringe a third party's rights, impersonate a real entity or person, or otherwise violate these Terms.
• bypass, disable, or interfere with anti-abuse, moderation, or rate-limiting systems
• use the Service for any unlawful purpose or in violation of any applicable law

You are solely and fully responsible for any text or content you submit, including any fund name. You represent and warrant that you have the rights necessary to submit it and that it does not, to your knowledge, infringe, misappropriate, or violate any third party's rights.

4. Leaderboard & User Content

Scores are automatically submitted when you complete a game. If your score qualifies, your chosen fund name and score may be displayed publicly on the leaderboard. The leaderboard is a fictional in-game ranking and does not represent any real fund, real performance, or real ranking of any kind.

By submitting any content to the Service (including a fund name), you grant the operator a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, fully sublicensable license to host, store, reproduce, display, distribute, modify, anonymize, translate, and remove that content for any purpose related to operating, providing, promoting, and improving the Service. You also represent and warrant that (a) the content is fictional, (b) you own or otherwise control all rights necessary to grant this license, and (c) the content does not violate Section 3 or any third party's rights.

No responsibility for user submissions. The operator does not pre-screen, endorse, verify, sponsor, or adopt any user-submitted content. All user submissions (including fund names appearing on the leaderboard) are the sole responsibility of the person who submitted them and do not represent the views, opinions, or affiliations of the operator. To the maximum extent permitted by law, the operator disclaims all liability arising from or relating to user-submitted content, including any submission that turns out to infringe a third party's rights or otherwise violate these Terms.

Right to remove. We may refuse, edit, redact, anonymize, suspend, or remove any leaderboard entry, fund name, score, or other user submission, and may block any user, where we believe in good faith that the submission infringes a third party's rights, violates these Terms, is abusive or unlawful, or is otherwise inappropriate for the Service. We will act reasonably and consistent with applicable law.

5. Intellectual Property

All game content, code, design, and visuals are owned by or licensed to the operator and protected by applicable intellectual property laws. Do not copy, reproduce, or create derivative works without written permission.

In-game text, names, scenarios, and outputs displayed during play are fictional and generated by the Service; they are owned by or licensed to the operator and are not authored by users. The only user-authored content is the fund name a player submits to the leaderboard, which is governed by Sections 3 and 4.

6. Disclaimer Of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

7. Limitation Of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY. THE OPERATOR'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED TEN US DOLLARS (USD $10.00).

8. Indemnification

You agree to indemnify and hold harmless the operator from any claims, damages, or expenses (including reasonable legal fees) arising from (a) content you submit to the Service or (b) your breach of these Terms or violation of any law or third-party right.

9. General

We may suspend or terminate access where reasonably necessary to operate the Service or to address a breach of these Terms. Any dispute shall be resolved on an individual basis; you waive any right to class or collective action. If any provision is found unenforceable, the rest remain in effect. These Terms and the Privacy Policy are the entire agreement. We may update these Terms at any time; continued use after changes constitutes acceptance.

10. Assignment, Transfer & Successors

The operator may assign or transfer these Terms and all related rights, licenses, user content, data, and assets, without notice or user consent, in connection with any sale, merger, acquisition, change of control, financing, reorganization, or insolvency proceeding. The licenses granted in Section 4 run to the operator's successors and assignees and survive any such transaction.
